Pet Care Services — Terms and Conditions

1. Acceptance of These Terms

1.1 These Terms and Conditions apply to all pet care, animal care, pet sitting, dog walking, animal supervision, transport, feeding, welfare checks and other services provided by PawrentalGuidance (“PawrentalGuidance”, “we”, “us” or “our”).

1.2 By requesting, booking, engaging, commencing or otherwise accepting our services, the animal owner or person responsible for the animal (“Owner”, “you” or “your”) acknowledges that they have read, understood and agreed to be bound by these Terms and Conditions.

1.3 By agreeing to PawrentalGuidance providing services, you are expressly agreeing to these Terms and Conditions. These Terms form part of the agreement between you and PawrentalGuidance.

1.4 If you do not agree to these Terms and Conditions, PawrentalGuidance may decline to provide services to you or your animal.

1.5 Where an Owner books or arranges services on behalf of another person, the person making the booking confirms that they have authority to do so and that these Terms apply to the Owner and the animal concerned.

2. Nature of Pet Care Services

2.1 PawrentalGuidance provides animal care services as agreed with the Owner at the time of booking.

2.2 The precise services provided may vary depending on the animal, the Owner’s instructions, the agreed booking and circumstances encountered while the animal is in our care.

2.3 PawrentalGuidance will use reasonable care, skill and diligence when providing services.

2.4 While we will take reasonable steps to care for animals appropriately, the Owner acknowledges that animals are living beings and their behaviour, health and responses can be unpredictable.

3. Acknowledgement of Risks

3.1 The Owner acknowledges and accepts that there are inherent and unavoidable risks associated with the care, handling, supervision, transportation and management of animals.

3.2 These risks may include, without limitation:

  • injury, illness or death;

  • bites, scratches, kicks, knocks or other physical injuries;

  • escaping, running away or becoming lost;

  • interactions with other animals, people, vehicles or environmental hazards;

  • anxiety, stress or behavioural changes;

  • damage to property;

  • pre-existing medical conditions becoming apparent or worsening;

  • allergic reactions or unexpected medical events;

  • illness or injury arising from circumstances outside PawrentalGuidance’s reasonable control; and

  • unpredictable or aggressive behaviour, even where an animal has previously displayed no such behaviour.

3.3 The Owner acknowledges that PawrentalGuidance cannot guarantee that an animal will remain free from injury, illness, escape, behavioural incidents or other adverse events while receiving services.

3.4 The Owner accepts that some risks cannot reasonably be eliminated despite appropriate care being taken.

3.5 The Owner agrees to provide PawrentalGuidance with all information reasonably relevant to the safe care of the animal, including known behavioural issues, aggression, anxiety, escape tendencies, medical conditions, allergies, medications, dietary requirements and any known triggers.

3.6 The Owner must not knowingly withhold information that could reasonably affect the safety or welfare of the animal, PawrentalGuidance, other animals or other people.

4. Owner’s Responsibilities

4.1 The Owner is responsible for providing accurate and complete information about the animal.

4.2 The Owner confirms that, to the best of their knowledge, the information provided to PawrentalGuidance is accurate and not misleading.

4.3 The Owner must notify PawrentalGuidance of any relevant change in the animal’s health, behaviour, medication, circumstances or requirements.

4.4 The Owner is responsible for ensuring that the animal has appropriate vaccinations, registrations, identification, licences and other legally required documentation where applicable.

4.5 The Owner must provide suitable equipment and supplies where these are reasonably necessary for the agreed services, including leads, harnesses, food, medication and other relevant items.

4.6 The Owner remains responsible for the animal’s underlying health, behavioural history and general welfare.

5. Emergency Veterinary Treatment

5.1 If PawrentalGuidance reasonably believes that an animal requires urgent veterinary attention, PawrentalGuidance may arrange or facilitate veterinary treatment where reasonably necessary.

5.2 The Owner authorises PawrentalGuidance to seek emergency veterinary assistance where PawrentalGuidance reasonably considers it necessary to protect the animal’s health or welfare and the Owner cannot reasonably be contacted in time.

5.3 The Owner remains responsible for veterinary, medical, medication, transportation and other third-party costs incurred for their animal, unless otherwise agreed in writing.

5.4 PawrentalGuidance will make reasonable efforts to contact the Owner or nominated emergency contact where circumstances permit.

6. Insurance

6.1 PawrentalGuidance maintains business insurance intended to provide cover for certain risks associated with its business activities, subject to the terms, conditions, exclusions, limits and requirements of the relevant insurance policy.

6.2 The existence of insurance does not mean that every incident, loss, injury, claim or circumstance will be covered.

6.3 Insurance claims are subject to the insurer’s assessment and the applicable policy terms. PawrentalGuidance does not guarantee that an insurer will accept any particular claim.

6.4 Where an incident is potentially covered by PawrentalGuidance’s business insurance, PawrentalGuidance may notify or lodge a claim with its insurer where appropriate.

6.5 Where a claim relating to an Owner, their animal or their property is accepted by PawrentalGuidance’s insurer and an insurance excess of $1,000 is payable by PawrentalGuidance in connection with that claim, the Owner agrees to reimburse PawrentalGuidance for the applicable $1,000 insurance excess, to the extent legally permitted.

6.6 The Owner acknowledges that the $1,000 excess is payable separately from any other fees, costs or expenses for which the Owner may be responsible under these Terms.

6.7 The Owner acknowledges that PawrentalGuidance’s insurance is primarily a business risk-management arrangement and is not a substitute for the Owner maintaining appropriate insurance for their own animal, property or other interests.

6.8 Nothing in these Terms guarantees insurance coverage or creates a right for the Owner to make a claim directly against PawrentalGuidance’s insurer.

7. Liability

7.1 PawrentalGuidance will take reasonable care when providing services. However, the Owner acknowledges and accepts the inherent risks associated with animals and animal care described in these Terms.

7.2 To the maximum extent permitted by law, PawrentalGuidance is not responsible for loss, damage, injury, illness or death arising from circumstances outside PawrentalGuidance’s reasonable control or from inherent risks associated with the animal.

7.3 This does not exclude, restrict or modify any rights, guarantees, warranties or remedies that cannot lawfully be excluded, restricted or modified under applicable Australian law.

7.4 Nothing in these Terms is intended to exclude liability where such exclusion would be unlawful.

7.5 Where PawrentalGuidance is legally liable for a loss, liability will be dealt with in accordance with applicable law and any valid limitation or exclusion permitted by that law.

8. Animal Behaviour and Safety

8.1 The Owner acknowledges that animals may behave unpredictably, particularly when separated from their Owner or placed in unfamiliar circumstances.

8.2 PawrentalGuidance may refuse, suspend or terminate services if an animal presents a reasonable risk of injury or danger to itself, PawrentalGuidance, another person or another animal.

8.3 Where reasonably possible, PawrentalGuidance will contact the Owner before making such a decision.

8.4 If immediate action is reasonably necessary for safety reasons, PawrentalGuidance may take appropriate steps without prior approval from the Owner.

8.5 Additional costs reasonably incurred as a result of an animal’s unexpected behaviour, emergency circumstances or special requirements may be charged to the Owner where agreed or permitted by law.

9. Damage to Property

9.1 The Owner acknowledges that animals may damage furniture, fittings, property, equipment, gardens, vehicles or other items.

9.2 The Owner accepts responsibility for damage caused by their animal to the extent that the Owner is legally responsible for that damage.

9.3 PawrentalGuidance may notify the Owner of any significant damage caused during the provision of services.

10. Medication and Special Requirements

10.1 The Owner must provide clear and accurate instructions for any medication, dietary requirements or special care.

10.2 Medication must be provided in its original packaging where reasonably possible and accompanied by appropriate instructions.

10.3 PawrentalGuidance will take reasonable care when administering medication that it has agreed to administer.

10.4 PawrentalGuidance is not responsible for consequences arising from inaccurate, incomplete or withheld information supplied by the Owner.

11. Keys, Access and Property

11.1 Where the Owner provides keys, access codes, remotes or other means of accessing premises, the Owner authorises PawrentalGuidance to use them solely for providing the agreed services.

11.2 The Owner is responsible for ensuring that PawrentalGuidance has appropriate access to the animal and premises at the agreed times.

11.3 PawrentalGuidance will take reasonable care of keys and access information provided for the purpose of the services.

12. Cancellation and Changes to Bookings

12.1 Cancellations and changes to bookings are subject to any cancellation policy or fees communicated to the Owner at the time of booking.

12.2 PawrentalGuidance may cancel or decline a booking where circumstances arise that make it unreasonable or unsafe to provide the services.

12.3 Where PawrentalGuidance cancels a booking for reasons within its control, any refund or alternative arrangement will be considered in accordance with the agreed booking terms and applicable law.

13. Fees and Payment

13.1 The Owner agrees to pay the fees applicable to the services booked.

13.2 Fees, payment dates and any applicable additional charges will be communicated to the Owner before or during the booking process.

13.3 The Owner remains responsible for properly authorised third-party costs incurred on behalf of the animal, including veterinary expenses, where applicable.

13.4 Any unpaid amount may be pursued by PawrentalGuidance in accordance with applicable law.

14. Personal Information and Emergency Contacts

14.1 The Owner may be required to provide contact information, emergency contact details and information relating to the animal.

14.2 PawrentalGuidance will use such information for purposes reasonably connected with providing the services, communicating with the Owner and responding to emergencies.

14.3 The Owner is responsible for ensuring that emergency contact information is current and accurate.

15. Termination of Services

15.1 Either party may terminate an ongoing arrangement for pet care services by providing reasonable notice, subject to any specific booking or service agreement.

15.2 PawrentalGuidance may immediately suspend or terminate services where reasonably necessary because of:

  • safety concerns;

  • aggressive or dangerous animal behaviour;

  • material non-disclosure by the Owner;

  • non-payment;

  • unreasonable or abusive conduct;

  • a significant breach of these Terms; or

  • circumstances that make it impractical or unsafe to continue providing services.

15.3 Termination does not affect rights or obligations that arose before termination.

16. Indemnity

16.1 To the maximum extent permitted by law, the Owner agrees to indemnify PawrentalGuidance against reasonable loss, damage, liability, costs or expenses arising from the Owner’s breach of these Terms, inaccurate or withheld information, or the acts or omissions of the Owner or their animal, except to the extent caused by PawrentalGuidance’s own unlawful conduct or negligence.

16.2 Nothing in this clause requires the Owner to indemnify PawrentalGuidance to the extent that doing so would be prohibited by law.

17. Changes to These Terms

17.1 PawrentalGuidance may update these Terms from time to time.

17.2 The version of the Terms applicable to a particular booking will be the version accepted by the Owner at the time the booking is made, unless otherwise agreed.

17.3 Where a material change is made to an ongoing arrangement, PawrentalGuidance will provide reasonable notice where required.

18. Governing Law

18.1 These Terms are governed by the laws applicable in the jurisdiction in which PawrentalGuidance operates.

18.2 Any dispute will be dealt with in accordance with applicable Australian law and any mandatory consumer protection or dispute-resolution requirements.

19. Severability

19.1 If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.

20. Entire Agreement

20.1 These Terms, together with any specific written booking or service agreement between PawrentalGuidance and the Owner, constitute the agreement relating to the provision of the relevant services.

20.2 If there is an inconsistency between these Terms and a specific written agreement, the specific written agreement will apply to the extent of the inconsistency.

21. Owner Acknowledgement and Agreement

By booking, requesting, accepting or commencing services with PawrentalGuidance, the Owner confirms that:

  • they have read and understood these Terms and Conditions;

  • they understand that animals involve inherent and unpredictable risks;

  • they accept that PawrentalGuidance cannot guarantee that an animal will remain free from injury, illness, escape or other incidents;

  • they have provided accurate and relevant information about the animal;

  • they understand that PawrentalGuidance maintains business insurance subject to the insurer’s policy terms and conditions;

  • they understand that insurance coverage is not guaranteed for every incident or claim;

  • where applicable and legally permitted, they agree to pay the $1,000 insurance excess associated with an accepted insurance claim relating to their animal, property or booking;

  • they understand that these Terms apply to the services they have requested or accepted; and

  • by agreeing to PawrentalGuidance providing services, they agree to be bound by these Terms and Conditions.
